Terms of Service
These Terms of Service (“Terms”) govern your use of woodvivos.shop and any purchases of products or commissions from Woodvivos Studio (“Woodvivos,” “we,” “us,” “our”). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.
1. Our Products and Services
We offer:
Physical products such as art prints, stickers, and framed prints
Digital products such as digital art files
Custom commissions, including digital pet portraits and other artwork
All prices are listed in Canadian dollars (CAD) and are subject to change without notice.
2. Ordering & Payment
Orders are placed through our Site or, in some cases, directly via email/social media if we agree.
Payment is due in full at the time of order.
We accept the payment methods displayed at checkout (e.g., credit card, PayPal, etc.).
Your order is not confirmed until payment is successfully processed.
We reserve the right to refuse or cancel any order if fraud is suspected, stock is unavailable, or there is an error in price or listing.
3. Custom Commissions
For commissions (such as pet portraits):
Payment is taken upfront to reserve your slot.
You are responsible for providing clear, well-lit reference photos and any important notes or preferences.
The artwork will be created in our own style, and by commissioning us you are trusting our artistic judgment.
Unless otherwise agreed in writing, commissions are non-refundable once work has begun.
For most pet portraits, we do not include revisions, except to fix obvious mistakes on our side. If you need specific changes, contact us before ordering to confirm if it’s possible and whether extra fees apply.
(You can adjust this section if you ever decide to offer a sketch stage or paid revisions.)
4. Digital Products
Digital files (e.g., JPG/PNG of your portrait or art print) are delivered by email or download link.
Once a digital file has been delivered, the sale is final and non-refundable.
You are responsible for backing up the files after download.
5. Physical Products, Shipping & Risk
Physical products (prints, stickers, framed art) are shipped to the address you provide at checkout.
Shipping options, flat rates, and processing times are described in our Shipping Policy, which is part of these Terms.
Once an order is handed to the carrier (e.g., Canada Post), risk of loss transfers to you. We are not responsible for shipping delays outside our control, but we will do our best to help track issues.
6. Returns, Refunds & Cancellations
Because many of our products are made to order or custom:
Commissions and digital products: final sale; no refunds once work or delivery has started, except where required by law.
Prints and physical products:
We do not accept returns for a change of mind.
If an item arrives damaged or defective, contact us within 7 days of delivery with photos, and we will work with you to replace or refund as appropriate.
If you need to cancel an order, contact us as quickly as possible. If production or shipping has already started, we may not be able to cancel.
7. Colours and Display
We try to show colors and details accurately, but differences between screens, monitors, and printers may cause slight variations in color or contrast. These variations are not considered defects.
8. Intellectual Property & Usage Rights
Unless stated otherwise:
Woodvivos Studio retains all copyright and intellectual property rights in the artwork, designs, illustrations, and images.
When you purchase a print, sticker, or digital file, you are buying a personal-use license only. You may:
Display the artwork in your home or personal space
Share photos of it on social media with credit/tagging (e.g., @woodvivos.shop)
You may not:
Reproduce, copy, or resell the artwork or prints
Use the artwork for commercial purposes (branding, merch, NFTs, etc.) without written permission
Remove signatures, crop out credit, or misrepresent our work as your own
Use the artwork in AI training datasets, image generators, or similar tools
Commercial licenses can sometimes be arranged separately. Contact us to discuss.
9. User Content
If you tag us or send us photos of our work in your space, you give Woodvivos permission to share or repost those images on our social media or website (unless you clearly tell us not to).
10. Limitation of Liability
To the fullest extent permitted by law:
We are not liable for any indirect, incidental, or consequential damages arising from your use of the Site or purchase of products.
Our total liability for any claim will not exceed the amount you paid for the product or service involved.
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
11. Governing Law
These Terms are governed by the laws of the Province of Ontario, Canada, and applicable federal laws of Canada. Any disputes will be handled in the courts of Ontario.
12. Changes to These Terms
We may update these Terms from time to time. When we do, we’ll update the “Last updated” date at the top. Your continued use of the Site after changes means you accept the revised Terms.
